At Professional Presence Web Design Agency, we’re committed to providing clear, high-quality service to professionals, consultants, and experts who need to present themselves credibly online. These terms explain how we work with clients, what’s included in our website and hosting services, and what to expect throughout your project.

By hiring us or continuing to engage with our services, you agree to the terms outlined below.


1. Scope of Services

We offer full-service website design, development, and managed hosting tailored to professionals, consultants, and thought leaders. Typical services include:

  • Custom, mobile-responsive website design

  • Content guidance (copy, imagery, bios, credentials, branding assets)

  • Brand-aligned design using your chosen colors, fonts, and tone

  • Secure, U.S.-based hosting with ongoing maintenance and updates

  • Optional integrations such as consultation forms, calendars, email opt-ins, or document sharing

  • Add-on services such as SEO, blogging, CRM setup, or digital branding materials

Your specific deliverables will be defined in your proposal or project scope. Additional requests may require a change order and separate pricing.


2. Client Responsibilities

A successful project depends on timely collaboration. Clients agree to:

  • Provide required content (bios, headshots, credentials, service info, etc.) in a timely manner

  • Respond to feedback and approvals promptly

  • Review and approve deliverables within agreed timelines

  • Ensure any third-party content provided is properly licensed

If content is delayed, placeholder text or stock imagery may be used temporarily to keep the project moving.


3. Revisions & Approval Process

Each project includes a defined number of revision rounds, which will be confirmed during onboarding. A “revision round” is considered one grouped set of feedback on a draft.

Additional revisions or significant changes after design approval may incur added time and cost.

We use a three-step review process:

  1. Initial concept and direction

  2. Full site design draft

  3. Final review before launch

Final written approval is required before your website is launched.


4. Hosting & Maintenance

Websites are hosted exclusively on our managed platform, which includes:

  • U.S.-based servers with daily backups and uptime monitoring

  • Routine plugin and core software updates

  • Support for domain-based email (reasonable use)

  • Monthly content updates (limits vary by plan)

  • Technical support for included features

  • Access to premium plugins and software tools (as applicable to your hosting plan)

We do not provide support for self-hosted sites unless separately agreed in writing. If hosting is canceled, access to our licensed software will also end.


5. Intellectual Property & Licensing

All original design and code remain the intellectual property of Tamar Cove Engineering, LLC unless otherwise agreed.

Clients receive a non-exclusive license to use the final website under an active hosting agreement. Premium software licenses (e.g., plugins) provided by us are not transferrable.

We reserve the right to showcase completed projects in our portfolio unless otherwise requested in writing.


6. Project Delays, Pauses & Cancellations

If you do not provide content or feedback by agreed milestones, the project may be paused. A restart fee may apply if work resumes later.

If a project is canceled after work has started:

  • You are responsible for the value of completed work to date

  • Deposits are non-refundable

  • Milestone payments already made are considered earned

Hosting renews automatically unless canceled with 30 days’ written notice.


7. Accessibility & Compliance

We build websites with accessibility, privacy, and readability in mind. However, full compliance with legal or regulatory frameworks (such as ADA, HIPAA, GDPR, etc.) is ultimately the client’s responsibility.

If you require compliance audits, privacy policies, or other legal components, we are happy to assist or integrate third-party solutions at your request.


8. Limitations & Disclaimers

While we strive to deliver exceptional results, we do not guarantee:

  • Specific search engine rankings or marketing performance

  • Continuous uptime (though we aim for high availability)

  • Outcomes from integrated tools or platforms

We are not responsible for issues caused by third-party changes or modifications made after launch. We also do not provide legal, financial, or medical advice.


9. Refunds & Payment Terms

Web Projects

Because every website is custom:

  • All sales are final once the project begins

  • Deposits are non-refundable

  • Milestone payments are earned as work is completed

  • In case of cancellation, we’ll work with you to settle fairly

Hosting

Hosting is billed annually with a one-year minimum term. After that:

  • You may cancel hosting with 30 days’ written notice

  • No refunds are issued for unused portions of a billing cycle

  • Premium plugin access ends when hosting ends

Digital Products (if offered)

If downloadable resources or templates are offered in the future, all sales will be final unless otherwise noted.


10. Acceptance of Terms

By hiring us, using our services, or accessing a site we’ve built or hosted, you acknowledge and accept these terms. If you have questions, please ask before we begin work.
